New Regulations for Underground Storage Tanks

As of October 13, 2015, the New York State Department of Environmental Conservation (NYSDEC) has adopted the EPA’s new regulations for underground storage tanks (UST).

NYSDEC has revised its regulations for petroluem bulk storage (PBS) and chemical bulk storage (CBS) and for the management of used oil. The new revisions reflect changes in State laws and federal laws and regulations.

The PBS and CBS revisions are effective October 13, 2015; the used oil revisions are effective November 10, 2015.

6 NYCRR parts 612, 613 and 614 have been repealed and replaced with the new 6 NYCRR Part 613.

The new regulations cover:

  • Requirements for installing, repairing and closing an UST
  • Incidents that must be reported
  • Requirements for spill and overfill prevention, corrosion protection, release detection, record-keeping, and operator training
  • Financial responsibility issues
  • Actions that must be taken in response to UST releases
  • How to ensure compatibility with biofuels and other regulated substances
